House Enrolled Act 1482

House Enrolled Act 1482 is a new Indiana state law having an effective date of July 1, 2013.  The new law outlines procedures for expunging certain conviction records when specific conditions have been met.  This new state law also provides that state agencies may only consider arrests or criminal convictions that have not been expunged when making determinations as to whether to grant or renew a license.  Applications for initial license and for license renewal administered by the Securities Division contain the following question, “Have you ever been arrested or convicted of a crime?”  The Securities Division is working to amend the language of its application forms so that this question will appear as follows: “Have you ever been arrested or convicted of a crime that has not been expunged by a court?”  Until the Securities Division has amended its application forms, applicants should respond to the prior arrest/conviction question in the affirmative only if the applicant has been arrested or convicted of a crime that has not been expunged by a court.
