New Rules - September 19, 2013 The Auto Dealer Services Division (“Division”) of the Indiana Secretary of State’s office is alerting all dealers of the new Emergency Administrative Rules. The Division was given the authority by the Indiana General Assembly to change administrative regulations through emergency rulemaking. Please click here to view the Emergency Rules. The Division will begin the process of permanently changing the Administrative Rules. PLATES ON DEMAND DOWN, JUNE 15, 2013
Dear Hoosier Motor Vehicle Dealers,
The Auto Dealer Services Division of the Indiana Secretary of State’s office is alerting motor vehicle dealers to an upcoming interruption of the State’s “Plates on Demand” system. The network will be temporarily interrupted during routine network maintenance on Saturday, June 15, 2013. Secretary Lawson and the Auto Dealer Services Division understand Saturdays are a high volume day for the motor vehicle industry. Unfortunately, this interruption cannot be avoided at this time.
Attached is an emergency order allowing you to issue temporary interim plates to assist your customers during the interruption of service. The Auto Dealer Division staff members listed below are available to answer any questions related to the disruption of service. You may also contact your field auditor at the listed below.

Your business location must be in Indiana in order to be licensed.
This is not limited to a physical space but must include an office location that you visit, utilize for record keeping, and has readily available utilities. An Indiana business location is not a place that is vacant but for table and chairs with empty banker boxes, or serves only as a mail forwarding operation.
If you obtained your license and were advised or came to believe you only need a physical address and never have to work out of your Indiana location that is incorrect. Current law requires a business location in Indiana.
July 1, 2013 additional laws go into effect that add additional elements to what this office considers an established place of business. We recognize each business may be unique and we will work with each license holder individually.

IF you choose to renew your license and you have not been using your Indiana business location we invite you to take corrective steps prior to Dec 31, 2013. Failure to correct your office situation may result in administrative actions which could include revocation of your license and the imposition of fines.
IF you choose to renew but surrender your license after renewal, but prior to Dec 31, 2013 so you have additional time to make alternate arrangements with your home state, there will be no administrative consequences relating to your office location.
IF you choose at this time not to renew, please return your existing plates so as to avoid fines relating to a failure to return the plates.
If you remain eligible for Wholesale Dealer plates please look for our alerts about availability in late June or July of 2013.
Starting in early March 2013 the documents associated with Auto and Watercraft Dealer License will have a new appearance. The dealer license, off-site license, representative license, and the transaction receipts will be printed on 8.5 inch by 4 inch stock. See examples below:

Dealer – used plates
By rule, as a wholesale dealer you are eligible for used dealer plates. The used dealer plates are restricted to vehicles (inventory) primarily used or stored in Indiana.
If you do wish to renew your existing used –dealer plates, in order to assure compliance with the rule, we will need you to attach an explanation regarding the use of the plates to your application. Specifically, indicate whether your used dealer plates will be primarily on vehicles used or stored in Indiana. Please be advised, an audit may be scheduled thereafter for verification purposes.
If your use of your existing used dealer plates does not fit that criteria we respectfully suggest you check with the state in which your business operation is located or explore the use of transport operator plates.
If you wish to non-renew your dealer plates or vacate your business operation in Indiana, please submit your business license and dealer plates within 10 days of expiration or cessation of business. Failure to return all dealer plates exposes your dealership to a fine.

The Wholesale dealer license The Indiana wholesale license you wish to renew was approved contemplating that you had an established place of business in Indiana.
If you are doing business from other than an Indiana location, you are at risk of having your license revoked, not renewed or other consequences.
If your business operation is not located in Indiana, we will be happy to work with you in the surrender of your license without fines or other consequences where appropriate, as you obtain alternative licensing.

You must let us know if you choose to vacate your Indiana office location or business. In addition all plates and stickers must be promptly returned to our office. Failure to advise us and return the plates will result in the imposition of penalties. If you have a question or have already vacated your location please email us at dealers@sos.IN.gov so we can work with you to avoid a fine.

Plate On-Demand program update - Sept. 9, 2011
As a result of your input, you will now be able to add new customer information directly online that most dealers currently required to keep in separate paper logbooks! The system has been upgraded to include names and addresses as well as optional fields to input phone numbers and emails.
Again, your comments helped make this happen, and we are working on many other enhancements to our web services that will make doing business with the Indiana Secretary of State’s Auto Dealer Services Division easier than ever. Look for these capabilities to be available on Wednesday September 14, 2011.
