Pharmacy compliance with INSPECT is twofold. Submissions of controlled substance data must occur within seven (7) days of the dispensation of that controlled substance. If a controlled substance is dispensed on the 5th of the month, it must be reported to the INSPECT database before or on the 12th of that month t remain compliant with statute. The second component of compliance is that submissions must occur every seven (7) days if the facility is dispensing at least one (1) controlled substance prescription per week. A good process to ensure uploads occur within seven (7) days of each other is to have your facility follow a schedule when uploading. You could upload on the 1st, 7th, 14th, etc. of every month, or you could upload on a certain day of the week, for instance uploading every Monday. We also recommend overlapping dates when you create your .dat file. (Ex: Monday 1st-Monday 7th, then the next submission dates could run Monday 7th-Monday 14th.)
If your location dispenses less than one (1) controlled substance prescription a week you must submit a Zero Report to the program in lieu of electronic reporting for that time frame. Failure to submit controlled substance data in a complete and timely manner may result in the issuance of disciplinary action by the Indiana Board of Pharmacy and/or a personal appearance before the Board. Errant records do not make it into the INSPECT database. The failure of a pharmacy to correct errant records constitutes noncompliance. IC 35-48-7-8 (2) states, "The information is required to be transmitted under this section must be transmitted no more than seven (7) days after the date on which the controlled substance is dispensed."
When a pharmacy is found to be non-compliant an initial warning notification is sent. Upon the second instance of noncompliance a warning is sent via certified mail to the facility, restating the dates of submission and warning that the next issue of noncompliance will result in a board appearance scheduled for that location. When the pharmacy incurs the third instance of noncompliance, a board appearance notification is sent to the qualifying pharmacist of that location.
