A "rule" is the whole or any part of a state agency statement of general applicability that: (1) has or is designated to have the effect of law; and (2) implements, interprets, or prescribes: (A) law or policy; or (B) the organization, procedure, or practice requirements of the state agency. (IC 4-22-2-3)

The Natural Resources Commission adopts permanent rules for the Department of Natural Resources. The Commission's permanent rules are codified through the Legislative Services Agency at 312 IAC. A review of subjects and purposes of the Commission's rules is provided.

  • Temporary Rules
    The DNR Director adopts temporary or emergency rules. (I.C. 14-10-2-4). The Legislative Services Agency (LSA) also publishes these rules; however, because the lifetime of these temporary rules do not exceed one year, they are not codified by LSA.
  • Annotated Procedural Rules (312 IAC 3-1)
    The Commission has adopted procedural rules at 312 IAC 3-1 to assist with administrative review by the Commission and its Administrative Law Judges. To assist in understanding the practical application of these rules, an annotated version has been developed by the Division of Hearings. The Indiana Board of Licensure for Professional Geologists has also endorsed these procedural rules for its administrative reviews.
  • Annotated Navigable Waters Rules (312 IAC 6)
    One of the most asked-about areas of NRC responsibility is navigable waters. The Division of Hearings has recently developed a research aid to better understanding of the history and application of this important legal area. The aid annotates Commission rules for navigable waters but also goes beyond those rules to outline important precedents from Indiana and federal courts. Navigable Waterways Roster.

Petition for Rule Change

The Commission has developed a process by which a person may petition for a rule change for rules within the Commission's jurisdiction. Included is any rule proposal submitted by an individual, a corporation, an association, a local unit of government, another state agency, a federal agency, or another person. The person may seek the adoption of a new rule, an amended rule, a recodified rule, a rule repeal or a similar action with respect to a nonrule policy document.
