SECTION 103. (a) The definitions in IC 25-8, as amended by this
act, apply to this SECTION.
(b) Any license by the:
(1) state board of barber examiners (IC 25-7-5-1 (before its repeal
by this act)); or
(2) state board of cosmetology examiners (IC 25-8-3-1);
as effective on June 30, 2010, and before July 1, 2010, shall be treated
after June 30, 2010, as if the license had been issued by the state board
of cosmetology and barber examiners under IC 25-8-3-1, as amended
by this act.
(c) On July 1, 2010, all the powers, duties, orders, and liabilities of
the:
(1) state board of barber examiners (IC 25-7-5-1 (before its repeal
by this act)); or
(2) state board of cosmetology examiners (IC 25-8-3-1);
concerning the examination, licensing, and disciplining of a person
licensed or an applicant applying for a license under IC 25-7 (before its
(d) On July 1, 2010, the property and records of the:
(1) state board of barber examiners (IC 25-7-5-1 (before its repeal
by this act)); or
(2) state board of cosmetology examiners (IC 25-8-3-1);
concerning the examination, licensing, and disciplining of a person
licensed or an applicant applying for a license under IC 25-7 (before its
repeal by this act) or IC 25-8, as amended by this act, are transferred to
the state board of cosmetology and barber examiners under
IC 25-8-3-1, as amended by this act.
(e) Any rules adopted by the:
(1) state board of barber examiners (IC 25-7-5-1 (before its repeal
by this act)); or
(2) state board of cosmetology examiners (IC 25-8-3-1); and
in effect on June 30, 2010, shall be treated as rules of the state board
of cosmetology and barber examiners on July 1, 2010.
(f) Notwithstanding IC 25-8-3-7, the initial terms of office of the
members of the board appointed under IC 25-8-3-5 (as amended by this
act) are as follows:
(1) One (1) member appointed under IC 25-8-3-5(b)(1), as
amended by this act, and one (1) member appointed under
IC 25-8-3-5(b)(2), as amended by this act, three (3) years.
(2) One (1) member appointed under IC 25-8-3-5(b)(2), as
amended by this act, one (1) member appointed under
IC 25-8-3-5(b)(3), as amended by this act, and one (1) member
appointed under IC 25-8-3-5(b)(4), as amended by this act, two
(2) years.
(3) One (1) member appointed under IC 25-8-3-5(b)(1), as
amended by this act, and one (1) member appointed under
IC 25-8-3-5(b)(5), as amended by this act, one (1) year.
The governor shall specify the terms of the cosmetologist and barber
members described in subdivisions (1), (2), and (3) when making the
initial appointments.
(g) The initial terms of the appointed members begin July 1, 2010.
(h) This SECTION expires July 1, 2015.
