Synopsis: IHSAA advisory council and board membership. Establishes the Indiana advisory council on secondary school activities. Provides membership and responsibilities for the council. Provides that the Indiana High School Athletic Association (IHSAA) board of directors must include principals, athletic directors, and coaches with certain qualifications. Provides that a school in a school corporation may not be a member of or pay money to the association for any purpose unless the board of directors of the association complies with certain requirements concerning the advisory council and membership of the association board.

    A BILL FOR AN ACT to amend the Indiana Code concerning education.

Be it enacted by the General Assembly of the State of Indiana:

    SECTION 1. IC 20-10.1-30 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 1999]:
    Chapter 30. Indiana Advisory Council on Secondary School Athletics
    Sec. 1. As used in this chapter, "association" refers to the Indiana High School Athletic Association.
    Sec. 2. As used in this chapter, "athlete" means a student participating in a sport for which the association conducts a state tournament.
    Sec. 3. As used in this chapter, "council" refers to the Indiana advisory council on secondary school athletics established by section 4 of this chapter.
    Sec. 4. The Indiana advisory council on secondary school athletics is established.
    Sec. 5. The council has the following members:
        (1) One (1) member appointed by each state organization for

a boy's sport for which the association conducts a state tournament.
        (2) One (1) member appointed by each state organization for a girl's sport for which the association conducts a state tournament.
        (3) Two (2) parents of currently active secondary school athletes, appointed as follows:
            (A) One (1) parent appointed by the Indiana Association of Public School Superintendents.
            (B) One (1) parent appointed by the Indiana School Boards Association.
        (4) Two (2) former secondary school athletes who are no longer attending secondary school, appointed by the Indiana Sportswriters and Sportscasters Association.
    Sec. 6. (a) A member of the council may not be an employee nor serve on the governing board of the association.
    (b) A member of the council serves at the pleasure of the member's appointing authority.
    (c) An appointment to the council is for a two (2) year term.
    (d) A member whose term expires may be appointed for a subsequent term.
    (e) A member of the council may not receive per diem or compensation for service on the council.
    Sec. 7. (a) The members of the council shall elect a chairman and vice chairman by majority vote of the entire membership.
    (b) A majority vote of the entire membership is required for the council to take action.
    Sec. 8. The council shall do the following:
        (1) Meet with the board of directors of the association and advise the board of directors of the effect of the association's rules on participation in the sports represented by the council.
        (2) Recommend to the association changes in the association's rules.
        (3) Recommend to the association appropriate ways to honor all athletes and teams that participate in events under the auspices of the association.
        (4) Make recommendations to the association that the council determines are in the best interests of secondary school athletes and athletics in Indiana.
    Sec. 9. (a) For purposes of this section, the following apply:
        (1) A secondary school that has an enrollment in the eightieth percentile for total enrollment of all secondary schools in Indiana is a Class 1 school.
        (2) A secondary school that has an enrollment in the sixtieth percentile but not more than the seventy-ninth percentile for total enrollment of all secondary schools in Indiana is a Class 2 school.
        (3) A secondary school that has an enrollment in the fortieth percentile but not more than the fifty-ninth percentile for total enrollment of all secondary schools in Indiana is a Class 3 school.
        (4) A secondary school that has an enrollment in the twentieth percentile but not more than the thirty-ninth percentile for total enrollment of all secondary schools in Indiana is a Class 4 school.
        (5) A secondary school that has an enrollment in not more than the nineteenth percentile for total enrollment is a Class 5 school.
    (b) The board of directors of the association shall include the following from each class of school described in subsection (a):
        (1) One (1) secondary school principal appointed in the same manner as secondary school principals are appointed to the board of directors on January 1, 1999.
        (2) One (1) secondary school athletic director who:
            (A) holds no administrative position while serving on the board of directors; and
            (B) is appointed by the Indiana athletic directors association.
        (3) One (1) secondary school head coach who:
            (A) holds no administrative position while serving on the board of directors; and
            (B) is appointed by the combined Indiana coaches associations.
    Sec. 10. A school that is in a school corporation may not be a member of or pay money to the association for any purpose, unless the board of directors of the association does the following:
        (1) Formally considers each recommendation of the council.
        (2) Reports in writing to the council the board's decision on each recommendation of the council.
        (3) Provides meeting facilities and staff assistance for the council.
        (4) Reimburses members of the council for travel or other expenses incurred in participation on the council.
        (5) Has a board of directors that meets the membership requirements of section 9 of this chapter.

         (6) Complies with all provisions of this chapter.
