9:30 a.m. H.B., A.B., M.B. and S.B. V. STATE OF INDIANA-ELKHART COUNTY OFFICE DIVISION OF FAMILY AND CHILDREN AND FAMILY LEARNING CENTER

Children who had been adjudicated in need of services brought a civil action alleging that the State of Indiana--Elkhart County Division of Family and Children negligently recommended that they be returned to an abusive home. The State contends that it is immune from such action. The St. Joseph Superior Court dismissed the action, and the Court of Appeals affirmed. See H.B. v. State,

713 N.E.2d 300 (Ind. Ct. App. 1999                                                    ).  The plaintiffs seek transfer.
