According to the Indiana Constitution and state statute, the seven-member Judicial Nominating Commission works to fill appellate court vacancies. Chief Justice Randall T. Shepard will retire from the Court in March 2012. The Commission will consider applicants and select the three most qualified candidates as finalists. Gov. Mitch Daniels will select Indiana's 107th justice from among the three finalists.
