Frequently Asked Questions

INDOT has published responses to frequently asked questions regarding Indiana’s DBE program as it applies to the East End Crossing portion of the Ohio River Bridges Project.

How will the DBE bidding process for the East End Crossing differ from the current process?

For the East End Crossing procurement, the proposer teams must submit a DBE Performance Plan, which must include the following information:

  • the names of the DBEs that the team has committed to using at the time of submission of the team’s DBE Performance Plan;
  • an explanation of how the proposer team anticipates dividing DBE participation between construction and professional services;
  • an explanation for how the proposer team plans to recruit, solicit and evaluate potential DBEs; and
  • a description of demonstrated success with the DBE program.

Due to the project’s size, scope and complexity, we are not requiring proposer teams to tell us all of the DBEs they plan to use to meet the 9% DBE goal at the time of bid submission as we do on other INDOT contracts; however, we are requiring them to submit a much more detailed plan than we do on an average INDOT contract.  We believe that this will encourage proposer teams to provide creative ways to increase DBE participation on the project.

How will the DBE goal be set given the project delivery system? 

INDOT set a 9% DBE goal on the East End Crossing procurement after reviewing the work involved, the possible subcontracting opportunities and the availability of DBEs for various work required on the project.

Who will verify DBE participation?

INDOT and IFA will review the DBE Performance Plans submitted by the proposer teams and evaluate the plans as part of the selection process.

Who will be responsible for DBE compliance?

Several entities will be responsible for DBE compliance: the selected proposer team, INDOT and the FHWA.  As part of their DBE Performance Plan, the proposer teams will be required to tell us who their DBE compliance manager will be and what the manager’s reporting structure and responsibilities will be.  Also, INDOT will continue to monitor DBE compliance as it does on all INDOT contracts.  Finally the FHWA will provide oversight of INDOT on DBE compliance.

How do DBEs submit quotes for work on the East End Crossing?

How does the DBE reciprocity agreement work?

Indiana and Kentucky have signed an agreement to accept DBE certification from each other, which will allow firms certified in either state to qualify as DBEs in the other state for the Ohio River Bridges Project. This agreement will greatly expedite DBE participation in the project. Each state will make its list of certified DBE firms available to the other state, so if your firm is certified in either state, it will automatically be certified in the other.

Federal regulations require that a DBE must be certified in the state where it is performing work for DBE participation to count toward a contract. So this project-specific agreement will allow Indiana DBEs to be counted as DBE certified in Kentucky on the Downtown Crossing portion of the project and will allow Kentucky DBEs to be counted as DBE certified in Indiana on the East End Crossing portion of the project.  The reciprocity agreement applies only to DBE certification.  There is no reciprocity for prequalification, which is governed by each State’s separate laws and processes.
