NPDES Pesticide General Permit

Public Comment on Draft Permit

The Indiana Department of Environmental Management (IDEM) has issued a draft NPDES Pesticide General Permit to establish additional requirements for point source discharges from the application of pesticides to waters of the state. IDEM is accepting public comments on the draft rule no later than April 4, 2011.

Indiana is authorized by U.S. EPA to issue the NPDES General Pesticide Permit, which will regulate the application of biological and chemical pesticides used for mosquito and other flying insect pest control, aquatic weed and algae control, aquatic nuisance animal control and forest canopy pest control. The type of entity and the annual treatment area threshold will determine who will be required to seek permit coverage once the mandate takes effect on October 31, 2011.

U. S. EPA Mandatory Greenhouse Gas Reporting Rule

Reporting Deadline Extended

The deadline for reporting 2010 data under the Greenhouse Gas (GHG) Reporting Program has been extended to September 30, 2011. Entities required to submit data must register with the electronic GHG reporting tool (e-GGRT) no later than 60 days before the reporting deadline (August 1, 2011).

Pursuant to 40 CFR Part 98, suppliers of fossil fuels or industrial greenhouse gases (GHGs), manufacturers of vehicles and engines, and facilities that emit 25,000 metric tons or more per year of GHG emissions are required to submit annual reports to U.S. EPA. Use the steps below to determine if your facility is required to report.

  • Step One: Determine if your facility has any of the regulated source categories by using the Online Applicability Tool. Print and save results for your records.
  • Step Two: Calculate potential GHG emissions at your facility using the Greenhouse Gas Equivalencies* Calculator. If you determine that you exceed the 25,000 metric ton threshold then continue to Step Three. Most small business will fall below the 25,000 metric ton threshold and will not be required to report GHG emissions to U.S. EPA.
  • Step Three: Locate the applicable recordkeeping and reporting requirements in 40 CFR Part 98 by using the Information Sheets for Each of the Source Categories Covered in the Rule and the Resources by Subpart web pages.

* Because some of these GHGs have a higher global warming potential than others, emissions of gases other than CO2 are translated into carbon dioxide equivalents (CO2e) by using the gases’ global warming potentials. The GHG Emergency Rule uses CO2e as the metric for determining whether sources are covered by permitting programs.

Total GHG emissions are calculated by summing the CO2e emissions of all six constituent GHGs:

  • Carbon dioxide (CO2)
  • Methane (CH4)
  • Nitrous oxide (N2O)
  • Hydrofluorocarbons (HFCs)
  • Perfluorocarbons (PFCs)
  • Sulfur hexafluoride (SF6)
