Waste Tire Storage, Processing, and Transporting

The Indiana Adminstrative Code (329 IAC 15) sets guidelines for the proper handling, transporting, storage, and disposal of waste tires and waste tire facilities. Most individuals wishing to operate a waste tire storage facility or waste tire processing facility must first obtain a certificate of registration from IDEM. Anyone wishing to transport waste tires must also register with IDEM. Waste tire storage and processing facilities [PDF] are not allowed to accept waste tires unless the transporter is registered with IDEM [PDF].

Application Information

Waste Tire Storage and Processing

The application fee for a new certificate of registration for a waste tire storage facility is $500 and the annual fee is also $500. The application fee for a renewal or new certificate of registration for a waste tire processing facility is $200. There is no annual fee for waste tire processing facilities. IDEM has thirty (30) days to process waste tire registration applications but they are usually processed within a week. All waste tire certificates of registration expire five (5) years after issuance and then must be renewed. Renewals must be submitted sixty (60) days prior to the expiration date of the certificate of registration.

However, the following do not need to register with IDEM:

  1. A facility that recycles or reuses waste tires and operates under a valid solid waste processing facility permit issued by IDEM;
  2. A site at which waste tires are stored under a recycling program approved by IDEM; or,
  3. Transformed, new or remanufactured tires.
Compliance at Waste Tire Storage or Processing Facilities Includes:
  • Submitting application for registration, which may ask for a description of the operation activities, proposed storage or processing methods, written estimates of closure costs, and documented financial assurance;
  • Obtaining the proper registration before beginning any waste tire operation;
  • Accepting waste tires only from transporters registered with IDEM [PDF];
  • Ensuring wastewater is properly discharged, which may require an NPDES permit;
  • Maintaining the site as to not cause a public nuisance;
  • Draining and properly storing all tires;
  • Keeping daily tire records; and,
  • Submitting an annual report.

Waste Tire Transporting

To apply for registration for waste tire transporting, persons must submit an application along with a $25 registration fee. Registered transporters must dispose of any tires that are in their possession by appropriate means set out in 329 IAC 15. Waste tire transporters are also required to prepare and carry a Waste Tire Manifest Form (available on the IDEM Forms page) for all shipments of waste tires.

Requirements for Changing Ownership

IDEM registrations for waste tire collection or processing businesses or storage facilities [PDF]s are not transferable (refer to the Indiana Administrative Code at 329 IAC 15-4-9 and 329 IAC 15-3-13). Any person taking ownership of such a business or facility must re-apply to IDEM to be properly registered prior to engaging in these activities.
