The Indiana Department of Environmental Management (IDEM) and the Indiana Department of Homeland Security (IDHS) presented information sessions about the Tier II program in January 2014. The Indiana Emergency Response Commission (IERC) has deemed reporting through IDEM’s Regulatory Service Portal (RSP) mandatory beginning January 1, 2011. The RSP is an online system designed to assist facilities in meeting federal and state statutory notification/reporting requirements. This online system allows EPCRA notifications and reporting of sections 302, 311 and 312 (Tier II).
Facilities must complete and submit a one-time Indiana Electronic Subscriber Agreement (IESA) to IDEM prior to using the RSP for all EPCRA reporting. This process will ensure a secure submittal.

Facilities will be notified by email when the IESA is approved and can then login to the RSP to being the reporting process.
Returning RSP users or facilities with approved IESAs can login at any time to begin the EPCRA reporting process. Please note that all RSP users, including first-time users, will see the previously submitted information for the facility and have the ability to review, update, verify, certify and quickly resubmit it.
Facilities must also submit EPCRA reports to their respective Local Emergency Planning Committees (LEPCs) and local fire departments in accordance with the statutory timelines and the desired format. LEPC [PDF] and IERC contact information can be found on the IDHS website.
The Emergency Planning and Community Right-to-Know Act (EPCRA), also known as the Superfund Amendment and Reauthorization Act (SARA) Title III, has two major purposes:
To achieve these goals there are four main parts to reporting;
1) Section 302 of SARA Title III outlines requirements if an Extremely Hazardous Substance (EHS) is present at a facility in a quantity greater than or equal to the established Threshold Planning Quantity (TPQ). The presence of EHSs in such quantities designates a facility as a planning facility.
Form 302 Emergency Planning Notification - This form must be completed using the IDEM Regulatory Services Portal.
The facility must complete a 302 notification within 30 days of storing an EHS.
2) Section 304 of SARA Title III details the requirements for a facility's reporting of accidental releases of hazardous substances which will migrate off site. The release of any CERCLA hazardous substance or any EHS in excess of the established reportable quantity (RQ) for the substance must be reported immediately.
3) Section 311 reporting is the submission of either a Material Safety Data Sheet (MSDS) or a list of reportable chemicals under Section 312 of SARA Title III (stored chemicals in quantities greater than or equal to the minimum threshold levels), grouped by hazard category. If at any time after the initial submission
Form 311 Reporting - This form must be completed using the IDEM Regulatory Service Portal.
This supplemental information is due within 90 days of receiving the new chemical or information.
4) A facility required to prepare or have available MSDSs for hazardous chemicals/substances under OSHA must prepare and submit an emergency and hazardous chemical inventory form (Tier II). The types of chemicals and the requirements for reporting are
Form 312 Non Confidential Location Information - This form must be completed using the IDEM Regulatory Services Portal.
This is an annual reporting requirement due by March 1 of each year. It must be submitted to the IERC/IDEM through the Regulatory Services Portal and sent to the appropriate LEPC and local fire department. Additional information on how to meet the requirements of Section 311 and 312 is available on the U.S. Environmental Protection Agency Web site.
The Indiana Department of Revenue no longer mails out any HC-500 forms or related schedules to taxpayers. Those forms can be found on the DOR website.
After the Tier II Form is completed online, you will receive an emailed Copy of Record that contains instructions and a link to the Indiana Department of Revenue’s website on how to complete and submit the forms to the State of Indiana.
The due date each year for submitting the Hazardous Chemical Inventory Fee Return and payment is March 1.

Owners and operators are required to file the Hazardous Chemical Inventory Fee Return. It is important to note that 90% of the hazardous chemical inventory fees collected are returned to the local community for public education and implementation of safety measures concerning hazardous chemicals.
