Deed/Land-Use Restrictions: The property shall not be used for residential purposes, including the placement of any residential buildings for use as a human dwelling place; the installation and use of water wells is prohibited on the property; and the removal of soil in the upper 10 feet of the project area is prohibited without appropriate protective equipment and lawful disposal of the soil. These restrictions are enforced through an Environmental Restrictive Covenant placed on the property deed at the Jay County Recorder's Office, Instrument number 0400002.

Project Summary:

Preliminary investigations indicated that lead impacts were present in subsurface soil and groundwater as a result of a closed landfill on the adjacent property. One subsurface soil sample exceeded the IDEM action level of 1000 mg/kg (1820 mg/kg at 4-6' in boring MW-4). However, this sample contained fill material and pieces of scrap and was not considered representative of site conditions. All other subsurface samples from site characterization and confirmatory sampling were below closure standards. Eight consecutive quarters of groundwater data were collected below the IDEM RISC default value of 0.042 mg/L. As an added measure of protection, an Environmental Restrictive Covenant was placed onto the property deed prohibiting the use of the property for residential purposes, prohibiting the use of site groundwater, and prohibiting uncontrolled access to subsurface soil in the project area.
