All DMHA-approved Access Sites and service providers must ensure the applicant/participant and their family understand their rights and freedoms associated with enrollment in a State or federally funded intensive wraparound home and community-based services (HCBS) program, which include the following:

  1. Right to receive treatment that is provided in accordance with the Health Insurance Portability and Accountability Act (HIPAA), safeguarding the youth/family’s privacy of health information.
  2. Right to receive from all service providers effective, understandable, and respectful care that is provided in a manner compatible with their cultural health beliefs and practices and preferred language.
  3. Right to lead, participate and take a meaningful role in directing the person-centered treatment planning process to the maximum extent possible. Youth and family have the following freedoms/rights associated with their treatment and plan of care:
    1. Freedom of Choice in Providers: Youth and family has the right to select the DMHA-approved HCBS provider for each service documented on the plan of care (POC).
    2. Freedom of Choice in Services: Youth and family have the right to select the HCBS service(s) on the DMHA-approved plan of care from the available HCBS services the Participant is eligible to receive.
    3. Freedom to Change Provider or Services: Youth and family have the right to change any DMHA-approved HCBS service provider or service at any time during enrollment in a State or federally funded HCBS program.
  4. Right to question or disagree with a DMHA eligibility or authorization determination. Youth and family may exercise this right by following the Fair Hearings and Appeals process. Click here for information about Fair Hearings and Appeals.
