NEW MEDICAID HOME AND COMMUNITY BASED RULE  - PUBLIC COMMENT REQUEST

In January 2014, the Centers for Medicare and Medicaid Services (CMS) published regulations to better define the settings in which states can provide Medicaid Home and Community-Based Services (HCBS). The HCBS Final Rule became effective March 17, 2014. The HCBS Rule, along with additional guidance and fact sheets, is available on the CMS Home and Community Based Services site.

The Indiana Family and Social Services Administration (FSSA) is assessing all FSSA HCBS programs to identify areas where the new regulations on settings are supported, as well as areas that will need to be strengthened in order to align Indiana's HCBS programs with the CMS regulations. Strategies and timelines necessary for Indiana to come into full compliance with the CMS HCBS rule by no later than March 2019 have been proposed in the Statewide Transition Plan.

The Indiana Family and Social Services Administration is seeking public input on the transition plan. The Statewide Transition Plan will be open for public comment for 30 days, November 1 - December 1, 2014. This comment period will allow all HCBS consumers, providers and stakeholders an opportunity to provide input to the plan.
