Overview

Section 223(a)(13) of the JJDP Act provides that:
"juveniles alleged to be or found to be delinquent (committed an act that would be considered a crime if committed by an adult) shall not be detained or confined in any institution in which they have contact with adult persons incarcerated"

Exceptions

Accidental or inadvertent contact in secure areas of the facility not dedicated to juvenile offenders (e.g., sally port or booking area).
