[ATG] State reaches agreement with Indy-based Mister Quik

INDIANAPOLIS – The Indiana Attorney General’s Office and Mister Quik reached a $50,000 settlement today after the company faced a state lawsuit over its business practices. 

As part of the agreement, the company will refund the remaining consumers who filed complaints against the company and implement new policies to help ensure consumers are protected.

“We believe this agreement is appropriate and ensures the company’s policies align with state law,” said Abigail Kuzma, director and chief counsel of the Consumer Protection Division. “The Consumer Protection Division works hard to protect consumers and ensure they are treated fairly.”

Last year, the state filed a lawsuit against Indy Connection Electrical Contractors, Inc., doing business as Mister Quik Home Services, for allegedly misrepresenting the urgency of needed repairs to consumers and then charging unusually high prices for those services.

The company has since refunded the majority of consumers who filed complaints with the Attorney General’s Office. According to the settlement, Mister Quik will refund $5,568.95 to the two remaining consumers, and pay $9,431 in investigative costs and $35,000 to the Consumer Protection Fund.

Kuzma said Mister Quik agreed to implement policies and procedures to align with state law including:

·         Provide customers with written, completed home improvement contracts;

·         Maintain the appropriate licenses, registrations and permits when required;

·        Retain replaced parts for at least 72 hours after the work has been completed; and

·         Comply with the Indiana’s Credit Service Organization Act whenever the company assists a customer with financing.

The company will also be required to document transactions, including before and after pictures, for the next two years for any repair in excess of $1,000 or whenever an electrical panel, water heater, air conditioner or water softener is replaced.
