Taylor legislation to become law

INDIANAPOLIS—The Indiana General Assembly has approved a number initiatives during the 2013 legislative session proposed by State Senator Greg Taylor (D-Indianapolis). Sen. Taylor’s proposals address child care providers, school disciplinary actions and arrest record expungement. These acts are expected to be signed into law by the governor. Most new laws become effective July 1, 2013.

Child care ministries
Sen. Taylor has been actively involved with numerous pieces of legislation concerning the standards of child care in Indiana, including Senate Enrolled Act (SEA) 305, which seeks to streamline and strengthen standards of child care providers across Indiana. The measure establishes safety and sanitation guidelines in areas such as bathroom hygiene and transportation safety for establishments that are licensed and accept Child Care Development Fund vouchers as payment. The legislation also equalizes standards and investigative procedures across private care providers and child care services offered through religious establishments.

Use of restraints and seclusion in schools
Sen. Taylor co-authored
SEA 345, which seeks to minimize the use of dangerous restraints and isolation measures used to discipline students. The act creates a state commission to establish rules regarding the use of restraint and seclusion in schools and creates a model plan addressing those issues. The commission includes representatives from the Autism Society of Indiana and others. Based on the plan, all accredited public, private and charter schools will need to develop their own restraint and seclusion guidelines by the 2014-15 school year. The plans will focus on preventing restraints or seclusions that may cause harm, developing requirements for notifying parents and establishing training guidelines for staff.

Child care provider background checks
Child care providers, their employees and their volunteers will have to undergo national criminal history background checks before receiving licenses or beginning work under
House Enrolled Act (HEA) 1494, sponsored by Sen. Taylor. Currently, child care providers conduct only local background checks, which may not detect felonies related to the health or safety of a child, and sex offenses. Employers must report all arrests, criminal investigations and convictions to the Family and Social Services Administration. A care provider who employs an individual convicted of crimes relating to the health and safety of a child may receive a variety of penalties, including possible loss of licensure or becoming ineligible to accept child care vouchers as a form of payment.

Expungement
Sen. Taylor sponsored
HEA 1482 this session to expunge records of an individual’s arrest that was not prosecuted or whose conviction was overturned on appeal. In addition, HEA 1482 provides that a court shall expunge misdemeanor convictions and minor Class D felony convictions under certain circumstances, and that a court may expunge records concerning certain more serious felony convictions. Among other provisions of the bill, a court may order that a Class D felony be converted to a Class A misdemeanor if the defendant fulfills certain conditions. HEA 1482 is meant to ensure that individual criminal and arrest records accurately reflect judicial court findings.
