[s28] Sen. Crider’s Intimidation Legislation Passes House

STATEHOUSE (March 26, 2013) – The Indiana House of Representatives today passed legislation authored by State Sen. Michael Crider (R-Greenfield) allowing police to investigate threats posted electronically, including those on social networking websites.

Senate Bill 361, which passed the House 96-0 expands Indiana’s intimidation law by allowing police to investigate threats posted to social media platforms such as Facebook and Twitter. Currently, the law doesn’t specifically mention whether threats posted online can constitute intimidation.

“Over the past decade, technology has changed significantly and offenders continually use social media to post threats against others,” Crider said. “The passage of this bill will now give law enforcement agencies the power to investigate such threats.”

SB 361 also makes it a Class D felony to make a threat against an employee of a hospital, school, church or religious organization. Electronic threats directed toward any facility that is opened to the public may be included under the expanded definition of intimidation.

Last week, the House Committee on Courts and Criminal Code passed an amendment that increases the penalty if the threat is against a judge, bailiff, prosecuting attorney or deputy prosecuting attorney to a Class C felony.

The bill now moves back to the Senate for final legislative approval.
