STATEHOUSE- State Representative Mark Messmer (R-Jasper) House Bill 1027 passed out of the House on Monday with a 93-0 vote. HB 1027 is concerned with civil immunity for services in a state of emergency and now moves on to the Senate for further consideration.


“House Bill 1027 is also referred to the Good Samaritan Act,” said Rep. Messmer. “Basically in emergencies such as the Indiana state fair stage collapse volunteers who are asked to provide their services will not be held liable.” 


1027 Provides civil immunity to a registered architect, land surveyor, or professional engineer who provides, without compensation, professional services related to a declared emergency. However the bill does not provided immunity for willful or intentional misconduct. 


Other previous examples of emergencies in Indiana that an architect, land surveyor, or engineer could use their services are the floods that occurred in Columbus and the tornadoes that occurred in Henryville last year. 


If passed in the Senate, Indiana will join 25 other states including Illinois, Kentucky and Ohio who have similar laws such as 1027. The bill passed out of the judiciary committee with a vote of 11-0.  


“If a professional engineer helped out in an emergency, they should not be liable for any personal injury, wrongful death, property damage, or other loss of any nature relation to the professional’s acts, errors or omissions in the performance on the services” said Rep. Messmer 


The bill is receiving bipartisan support. The Senate sponsors are Senator Merritt and Senator Lanane.
